1 William Joe Mason, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Oklahoma County, Case No. CRF-75-4631, for the crime of Petit Larceny, After Former Conviction of a Felony in violation of 21 O.S. 1971 § 1701 [21-1701]. In accordance with the verdict of the jury, the defendant was sentenced, on the 17th day of May, 1976, to serve a term of three (3) years imprisonment. From said judgment and sentence a timely appeal has been perfected to this Court.
